1. Acceptance of Terms
Welcome to Brilliant Teaching App, including all related websites, mobile applications, AI-powered tools, content systems, APIs, subscription services, educational resources, and associated services (collectively, the “Services”), operated by Brilliant Teaching Group LLC (“Company,” “we,” “us,” or “our”).
By registering for, accessing, browsing, purchasing, or otherwise using the Services, you acknowledge that you have read, understood, and agree to be legally bound by these Terms of Service (“Terms”), our Privacy Policy, and any supplemental policies, guidelines, or business terms incorporated herein by reference.
IF YOU DO NOT AGREE TO THESE TERMS, YOU MAY NOT ACCESS OR USE THE SERVICES.
These Terms constitute a binding legal agreement between you and the Company.
USER ACCESS
2. Eligibility and Authorized Use
You represent and warrant that:
- You are at least eighteen (18) years of age, or the legal age of majority in your jurisdiction;
- If under the applicable age threshold, your use is authorized and supervised by a parent, guardian, or authorized educational institution;
- You possess full legal capacity to enter into binding agreements;
- You are not prohibited from using the Services under applicable law;
- You have not previously been suspended, terminated, or removed from the Services.
The Company reserves the absolute right, in its sole discretion, to deny, restrict, suspend, or terminate access to any user, jurisdiction, organization, or account at any time.
3. Account Registration and Security
Certain Services require registration. You agree to:
- Provide accurate, current, and complete information;
- Maintain confidentiality of login credentials;
- Accept full responsibility for all activities under your account;
- Immediately notify us of unauthorized use or security breaches.
You are solely liable for all account activity, whether authorized by you or not.
Strict Single-User Access / Credential Sharing Prohibition
Unless expressly authorized through a separate enterprise, institutional, district, team, or multi-seat licensing agreement issued by the Company, each subscription, login, and account is licensed exclusively to a single authorized user.
You expressly agree that you may NOT:
- Share login credentials with any other individual;
- Permit simultaneous or rotating access by multiple users;
- Transfer account access between employees, contractors, teachers, administrators, or institutions without authorization;
- Resell, sublicense, lease, distribute, or commercially share account access;
- Use one subscription to serve multiple educators, schools, departments, or organizations outside an approved license tier;
- Circumvent seat, user, district, or enterprise pricing structures.
Enforcement Rights:
The Company reserves the absolute right to:
- Monitor login patterns, IP activity, device usage, institutional overlap, and behavioral indicators suggestive of unauthorized account sharing;
- Suspend or terminate accounts suspected of unauthorized multi-party use;
- Retroactively bill users or institutions for unauthorized usage at applicable enterprise or commercial rates;
- Restrict platform features;
- Pursue contractual damages, injunctive relief, financial recovery, and legal remedies.
Unauthorized credential sharing constitutes material breach of these Terms and may result in:
- Immediate account suspension;
- Permanent termination;
- Forfeiture of subscription fees;
- Denial of future Services;
- Legal enforcement.
The Company’s failure to immediately enforce against unauthorized sharing does not waive future enforcement rights.
Institutional or organizational use beyond individual licensing requires formal written agreement.
PRODUCT USAGE
4. Permitted Use
The Services are licensed, not sold, solely for lawful, authorized, non-transferable use consistent with these Terms.
You may use the Services only for:
- Educational planning;
- Professional instructional support;
- Curriculum development;
- Institutional or enterprise educational applications explicitly authorized by the Company.
5. Prohibited Conduct
You expressly agree NOT to:
- Use the Services for unlawful purposes;
- Engage in academic dishonesty, fraud, or deception;
- Reverse engineer, scrape, copy, mine, decompile, or exploit the platform;
- Use platform outputs to train competing AI or machine learning systems;
- Circumvent security protections;
- Upload harmful code, malware, or unauthorized automation;
- Misrepresent institutional or user identities;
- Commercially exploit the Services without express written consent.
Violations may result in immediate suspension, termination, legal action, financial penalties, and referral to law enforcement.
REVENUE SYSTEMS
6. Subscriptions, Billing, and Payment
The Company may offer:
- Free access tiers;
- Paid subscriptions;
- Enterprise licenses;
- Promotional pricing;
- Institutional packages;
- Add-on services.
Billing Terms:
- Subscriptions automatically renew unless canceled before renewal;
- Fees are non-refundable except where required by law;
- Pricing may be modified at any time;
- Payment processors are third-party providers;
- Failed payments may result in immediate suspension;
- Promotional offers may be modified or revoked without notice.
You authorize recurring billing where applicable.
The Company bears no responsibility for third-party payment processor failures.

Your use of the Services is subject to our Privacy Policy.
By using the Services, you consent to:

All platform content, software, systems, frameworks, prompts, branding, AI structures, methodologies, and associated materials are the exclusive property of the Company or its licensors.

- Reports;
- Branding;

9. User Content License Grant
Users retain ownership of lawful submitted content, but grant the Company a:

- Irrevocable;
- Royalty-free;
- Transferable;
- Sublicensable license
to host, process, reproduce, adapt, improve, analyze, and distribute such content for service provision, system improvement, legal compliance, and product development.
Feedback provided may be used without compensation.
LEGAL EXPOSURE
10. Disclaimers of Warranty
THE SERVICES ARE PROVIDED “AS IS,” “AS AVAILABLE,” AND “WITH ALL FAULTS.”
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY DISCLAIMS ALL WARRANTIES, INCLUDING:
- Merchantability;
- Fitness for a particular purpose;
- Accuracy;
- Reliability;
- Educational efficacy;
- Non-infringement;
- Security;
- Service continuity.
No guarantees are made regarding:
- Learning outcomes;
- Instructional success;
- AI accuracy;
- Platform uptime.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW:
The Company shall not be liable for:
- Indirect damages;
- Lost profits;
- Educational outcomes;
- Institutional losses;
- Data loss;
- Service interruptions;
- Consequential damages.
Aggregate liability shall not exceed the greater of:
- Fees paid in the preceding twelve (12) months; or
- $100 USD.
12. Indemnification
You agree to indemnify, defend, and hold harmless the Company from all claims arising from:
- Your misuse;
- Legal violations;
- Educational misuse;
- User content;
- Institutional noncompliance;
- Security breaches caused by your conduct.
AI RISK
13. AI-Powered Features
The Services may include AI-enabled systems, recommendations, planning supports, or generated educational outputs.
You acknowledge:
- AI outputs may contain inaccuracies, omissions, biases, or outdated information;
- AI is not a substitute for professional, human judgment;
- Human review is mandatory;
- Outputs may not be unique;
- AI systems may evolve, change, or be discontinued;
- AI features may rely on third-party large language model providers.
Restrictions:
Users must NOT:
- Rely solely on AI for consequential educational decisions;
- Input protected or sensitive data where prohibited;
- Use outputs without professional verification.
The Company disclaims liability for AI-generated errors.
EDUCATION COMPLIANCE
14. Educational and Institutional Use
Users operating in educational environments represent compliance with all applicable laws, including but not limited to:
- FERPA;
- COPPA;
- Privacy Act requirements;
- Regional student data protections;
- Institutional governance policies.
Schools and educators are solely responsible for:
- Obtaining required consent;
- Providing disclosures;

The Services are educational aids only and do not replace teacher, administrator, or institutional judgment.
TECHNICAL ABUSE PREVENTION
15. Security and Platform Integrity
Users may not:

- Attempt unauthorized access;
- Replicate proprietary systems;
- Build derivative competing technologies using platform outputs.
The Company reserves rights to:

SERVICE ADAPTABILITY
16. Modification of Services and Terms
The Company may, at any time and without liability:
